Section II: Course Details

Detailed Description
Students examine the legislative framework surrounding the creation, operation and management of condominium corporations in Ontario. Protecting Condominium Owners Act, 2015 amends the Condominium Act, 1998 and introduces the licensing of condominium managers under the Condominium Management Services Act, 2015 (CMSA). Students explore a range of issues affecting condominium corporations in Ontario, including consumer protection, management contracts, dispute resolution and both recent and anticipated legislative reforms. Students will also be introduced to the major stakeholders in the world of condominium legislation and business, including various administrative authorities and regulators.

Creation and Organization of Condominiums

  • The requirements in the Condominium Act, 1998 for how a condominium corporation is created and named
  • Types of condominium corporations defined in the Condominium Act, 1998
  • The obligations and rights of purchasers of a condominium unit, including the role of status certificates
  • The turn-over process and what it entails
  • The role and obligations of the Board of Directors of a condominium, including who can be a Board member
  • The role of the Condominium Authority and the Condominium Authority Tribunal in a condominium

Operation of a Condominium Corporation

  • Types of meetings held in a condominium, what the notice requirements are and what needs to be provided to owners to prepare for meetings
  • Types of Information Certificates required, what is to be included in them and when they are to be sent out
  • Types of Condominium Returns required, what is to be included in them, timing for filing and consequences of failing to file
  • Types of records considered as core records, and the process for access and retention of records (both core and non-core)
  • Explore how changes are made in condominiums, including an examination of by-laws, rules, changes to the common elements, changing directors, changing auditors and making amendments to the Declaration

Licensing of Condominium Managers

  • The Condominium Management Regulatory Authority of Ontario (CMRAO) 
  • Types of licenses available and the requirements for each as legislated by the Condominium Management Services Act, 2015 (CMSA)
  • Obligations of licensees as defined by CMSA
  • Complaints and enforcement process for licensees

Defining Repair and Maintenance Obligations in a Condominium

  • Define what a reserve fund is used for and the types of studies required by legislation
  • Understand the obligations of repair and/or maintenance of the corporation and owners
  • Define the types of insurance required by the Condominium Act, 1998, and explore insurance deductibles and their implications
  • Explore the role of Tarion, its warranty periods, how deficiencies are repaired and what happens if they aren’t

Collections and Enforcement in a Condominium

  • Explore the common expense collection process, including registration of a condominium lien
  • Compare and contrast the dispute resolution proceedings available under the Condominium Act, 1998
  • Examine the various offences and penalties under the Condominium Act, 1998
